The punishment for the Italian mechanic was given by the Judges of the Court of Assizes of Naples. Carlo Diana was investigated by the Naples prosecutor's office for "voluntary assassination under self-defense conditions" after the death of a 37-year-old thief of Albanian origin with numerous precedents for crimes. The Albanian was left dead by the shooting, while the Italian owned legally the weapon.
The thief was left on the ground by his two other co-workers, who managed to leave the house where Carlo Diana and her entire family lived.
