The Constitution has stated that the successful voting of a no-confidence motion of the Assembly against the government does not result in the mandatory distribution of the Assembly and enables the formation of a new government.
“In the evaluation of the Decree [no. 24/2020] of 30 April 2020 of the President of the Republic of Kosovo, through which “Mr. Avdullah Hoti, is proposed to the Assembly of the Republic of Kosovo as a candidate for Prime Minister to form the Government of the Republic of Kosovo ”, the Court decided: (i) unanimously that the request of the applicants is acceptable; (ii) unanimously that the contested Decree of the President is in accordance with paragraph 2 of Article 82...”, the Constitutional Court's decision states.
While the LDK candidate for prime minister, Avdullah Hoti has commented on the decision of the Constitutional Court.
He said that the new institutions in Kosovo together with the allies should work on advancing Euro-Atlantic processes.
"As prime minister-designate of the Government of Kosovo, I welcome the decision of the Constitutional Court. It is time to unite for the future of the country and our citizens.
No one is lost. Restoring trust between us and respecting the institutional order is our common duty and obligation.
Together with our strategic friends, the United States and the European Union, we will work diligently to realize our aspirations for Euro-Atlantic integration."
On the other hand, Richard Allen Grenell - the Special Presidential Envoy for Serbia and Kosovo Peace Negotiations - says he is looking forward to starting work with Kosovo's new government.
