European Court of Human Rights and Human Rights Advocates Request Compensation for Gërdec Victims' Families

 This case is currently before the Grand Chamber of the European Court of Human Rights in Strasbourg, which states that over the years there has been progress, local media say.

According to the ruling of Strasbourg, the victims' families and victims should be part of the process from the beginning, while the case for Minister of Defence Fatmir Mediu is criticized.

The court is asking for a minimum of 12 million euros for Zamira and Feruzan Durdaj.

“The state of the victim should pay the claimants, within three months from the date when this decision enters into force, in accordance with Article 44 § 2 of the Convention, the following amounts: jointly Zamira Durdaj and Feruzan Durdaj, 12,000 euros (twelve million euros), plus any tax that can be paid for damages incurred; claimants who are eligible, 10,000 (ten million euros) each, plus any tax that can be paid for damages incurred; jointly for all claimants, 8,000 (eight million euros) euros, plus any tax that can be paid for damages incurred; from the third month onwards, a simple interest rate shall be paid for the total amount and more particularly with a higher rate of 3% interest, in accordance with the Central Bank of Albania's regulations on the period of non-payment plus three points of interest”, it is stated in the Strasbourg decision.

The individuals who submitted the case in Strasbourg are Zamira Durdaj and Feruzan Durdaj, their parents and other siblings Erison Durdaj, Feruzan Durdaj, Roxhens Durdaj, Alketa Hazizaj, Aishe Selami, Pashk Kaçi, Mirela Hazizaj, Miselda Zguri, Medi Gola, Rabie Gërdeci, Shaban Brahushi, Sabrie Picari, Dylbere Prini, Adelina Cani, Meltina Haka, Bege Aliu and Esmeralda Sefaj.

“At the time of the judgment Erison Durdaj, then 18 years old, had gone to the object with the owner Roxhens Durdaj, who was making a hole in the object and the teas of Erison, which was being made. Erison Durdaj was hit by the judgment and was transferred to an Italian hospital as an emergency, where he died on April 3, 2008. Roxhens Durdaj, then 11 years old, was hit by the flames of the judgment. The 28 claimants in the application no. 46707/13, as well as the second claimant in the application no. 46714/13 Alketa Hazizaj, were working in the object and were hit by the judgment'”, it is written in the Strasbourg decision.

The Strasbourg decision should be part of the process in the Court of General Prosecution.

The case against Minister of Defence Fatmir Mediu is reopened because Zamira Durdaj, who brings the most harm to the Gërdec, and which calls attention to the harm and calls it in the European Court of Human Rights.

Mediu was one of the accused for the year 2008 when Albania was hit by a judgment in a depot of weapons in Gërdec, in the outskirts of Tirana where 26 people died.
